These Terms of Service ("Terms") govern your access to and use of Appsessment (the "Service"). By creating an account, accessing, or using the Service, you agree to these Terms and our Privacy Policy.
1. Definitions
- App means a service/workspace created in Appsessment (e.g., a childcare centre or organisation).
- Owner means the person responsible for billing and administration of an App.
- User means any person who accesses the Service (including educators and parents) under an account.
- Content means information uploaded or created in the Service (including text, images, files, comments, and records).
2. Who may use the Service
The Service is intended for use by childcare services and authorised adults. You must be at least 18 years old (or have legal capacity in your jurisdiction) to create an account. Users invited into an App must use the Service only for its intended purpose and in accordance with these Terms.
3. Accounts, access, and security
- You are responsible for maintaining the confidentiality of your login credentials.
- You must promptly notify us if you suspect unauthorised access or misuse of your account.
- You must not share accounts or access another user's account without permission.
- If you choose a "Remember me" or similar extended-session option, use it only on a private device you control.
4. Privacy, children's information, and consent
Appsessment is a private communication and record-management platform. Content you upload may be visible to other authorised Users within your App (for example, educators, owners, and invited parents), depending on permissions and settings.
Consent and lawful basis: You are responsible for ensuring you have obtained any necessary consents and permissions (including from parents/guardians where required) before uploading or sharing children's information or images in the Service. You are also responsible for complying with applicable privacy and child-safety laws and your organisation's policies.
We do not independently verify the accuracy or legality of user-submitted Content. We may restrict access to or remove Content where we reasonably believe it violates these Terms, our policies, or applicable law.
5. Your Content and acceptable use
You retain ownership of your Content. You grant us a limited licence to host, store, process, and display your Content for the purpose of operating, providing, and improving the Service.
5.1 Prohibited conduct
You must not (and must not encourage others to):
- use the Service in a way that violates any applicable laws or regulations;
- upload unlawful, abusive, defamatory, obscene, hateful, or discriminatory content;
- attempt to gain unauthorised access to accounts, systems, or data;
- introduce malware or take actions that disrupt or overload the Service;
- scrape, harvest, or collect personal information from the Service without authorisation;
- share Content from the Service to public channels (e.g., social media) where not permitted.
The examples above are not exhaustive. We may take action where we reasonably believe conduct is unsafe, inappropriate, or harmful.
6. Data hosting and security
Primary application data is hosted on servers located in Australia. Encrypted backups may be stored securely off-site for redundancy, disaster recovery, and service continuity purposes.
We use reasonable administrative, technical, and physical safeguards to protect personal information and Content. However, no system is completely secure, and you use the Service at your own risk.
7. Fees and subscriptions
Subscription plans, pricing, and billing terms are provided during sign up or through our billing pages. If a subscription plan is cancelled or expires, access to paid features may be limited or removed.
8. Termination
You may stop using the Service at any time. We may suspend or terminate access if we reasonably believe there has been a violation of these Terms, misuse of the Service, or unlawful activity.
9. Changes to the Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top. Continued use of the Service after changes take effect indicates your acceptance of the revised Terms.
